Business Associate and Data Use Agreement with the American College of Surgeons

This Website will allow you to view and electronically sign the Business Associate and Data Use Agreement with the American College of Surgeons.

The American College of Surgeons has developed a standard Business Associate and Data Use Agreement for all of the quality improvement programs administered by the College. The new agreement includes the new HIPAA security rule requirements.

The quality improvement programs include:

  • National Surgical Quality Improvement Program (NSQIP) - http://site.acsnsqip.org/
  • Trauma Quality Improvement Program (TQIP) / National Trauma Databank (NTDB) / Trauma Verification - http://www.facs.org/trauma/index.html
  • Comission on Cancer (CoC) Accreditation / National Cancer Database (NCDB) - http://www.facs.org/cancer/index.html
  • National Accreditation Program for Breast Care Centers - http://www.napbc-breast.org/
  • Metabolic and Bariatric Surgery Accreditation and Quality improvement program (MBSAQIP) - http://www.mbsaqip.org/

You will only need to sign one Business Associate and Data Use agreement to cover all the quality improvement programs for your institution.

Please follow these steps to review and electronically sign the agreement - this procedure should be followed by the authorized signer at your institution:

  1. Read these instructions before you select "Click here to continue" below.
  2. You will be asked to fill in your name and email address.
  3. You will then receive an email with an access code
  4. Return to the website and input the access code
  5. You will now see the document, including fillable fields to enter the name of the covered entity, FEIN/Tax ID, address, and contact information at the Notice section on page 9
  6. The screen will allow you to confirm acceptance of the document (you may print the document if desired)
  7. After acceptance of the document, you will receive a confirmation email and the ACS will be notified of the document acceptance. The email will contain instructions on how to print the document if desired.
  8. The ACS will then counter-sign the document electronically.
  9. You will then receive another notification email that the College has counter signed the document. The email will contain instructions on how to print the document if desired.
